Terms and Conditions of "yellow" Rewards Program

Article 1 - Overview
1.1 The Program's purpose is to reward the Bank's customers (hereinafter the "Member/s") for their entire banking relationship with its products/services, as specified in each case by the Bank under various criteria, at the Bank's sole discretion (i.e. transactions, Members' participation in activities, competitions etc.).
1.2 Members are rewarded by accumulating points (hereinafter "yellows") in their yellow account (hereinafter the "yellow Account"), which is unique for every Member. yellows can be redeemed in accordance with these terms and conditions (hereinafter the "Terms"), as applicable.
1.3 In particular, Members acquire a unique identification code (hereinafter the "yellow Activation Code") to access their yellow Account, when enrolling in the program, in accordance with the instructions provided each time by the Bank. The yellow Activation Code is used for Member identification in the yellowday service, as referred to under article 4.1.c. but it may also be used in other cases in the future, depending on the services provided by the Program, in accordance with the Bank's instructions and recommendations.
1.4 By enrolling in the Program, Members are informed of these Terms, agree and unreservedly accept that these Terms govern exclusively the rights and any obligations arising from their participation in the Program.
Article 2 - Enrolment and Member Identification
2.1 Enrolment Options: Notwithstanding the provisions of Article 2.2, Members are enrolled in the Program by unreservedly accepting these Terms and by submitting an application through one of the following channels: the Bank's Branch Network (hereinafter "the Network"), electronically via the Winbank e-banking system (hereinafter "Winbank"), or by dialling the Bank's telephone customer service center 18218 (hereinafter "Contact Center"), provided they have phone banking codes. The Bank may provide other options of Membership enrollment throughout the entire duration of the Program, which will be announced in accordance with the provisions of Article 5.
2.2. Membership: New and current Bank customers (natural persons) who hold at least one active product or are provided a service by the Bank can participate in the Program as Members. To enroll, accumulate and redeem yellows, throughout the duration of the program, Members’ loan repayments must be up-to-date and show no arrears longer than sixty (60) calendar days, and/or the Member must not have filled for subjection under Law 3869/2010 and/or no other conditions must apply that may be included in the yellows Rewards Table, which forms an integral part of these Terms, as expressly stated in Article 3.3
2.3 The Bank reserves the right to accept or reject the Member's application to participate in the Program at its discretion, without notifying the reasons for rejection. It also reserves the right to add additional enrollment criteria or modify existing ones.
2.4 Members’ Contact Information: When enrolling, Members disclose to the Bank and/or update their mobile phone number and any other contact information requested by the Bank such as home address, e-mail address, etc. for the purposes of the Program (i.e. regarding enrollment, rewards statement, yellow Activation Code, yellows redemption, etc.), as well as for identification purposes.
2.5 Moreover, Members are requested to disclose in writing any change in their contact details (e.g. e-mail address, fixed/mobile phone etc.) to the Network or otherwise designated by the Bank during their participation in the program. Until such a change is notified to the Bank, any documents (in hard copy and/or electronic form), sent to the former address and/or any text messages (SMS) sent to the former mobile phone number, are considered valid, and the Bank will not be liable for any mail loss or lack of communication with the Member.
Article 3 - yellows Accumulation
3.1 Duration-Termination: The Program's yellows are valid for two (2) years from the date they are credited to the Program's yellow Account. yellows, not used within the period of validity, are automatically deleted from the yellow Account, and the Bank has no obligation to inform Members.
3.2 Transfer/Assignment etc.: yellows cannot be transferred or assigned to any third party, Member of the Program or not, they cannot be distributed, sold, exchanged, bequeathed or allocated to third parties or used by them, unless the Bank decides otherwise by amending the rewards options generally or individually.
3.3 yellows Rewards Table: Program Members accumulate yellows in accordance with the current yellows Rewards Table (hereinafter the "Table"), which forms an integral part of the Program Terms. The Table is posted on the Bank's official Program website and represents the current yellows rewards policy of Piraeus Bank. However, in case of delays referred to in 2.2, the accumulation of yellows discontinues automatically, even if the Member is using banking products and/or services that offer yellows rewards according to the Table.
3.4 The Table indicatively illustrates the following: a) the rewards options for Members, based for example on the frequent use of products, services and/or the Bank's service channels, the Members' banking relationship, the products/services and/or transactions involved etc., b) the yellows calculation method, the rounding method and any maximum number of yellows, which may be accumulated on a monthly and/or annual basis per reward option or as a total in a yellow Account, c) the yellows accumulation/display/availability criteria in a yellow Account, d) the yellows number, especially as regards the use of cards and e) the period in which yellows are credited to a yellow Account so that their accumulation is fully transparent and distinct.
3.5 In case yellows are inadvertently calculated resulting to the Member's benefit or expense, the Bank will unilaterally reinstate the yellow Account balance and notify the Member by any suitable means. In case of any yellows miscalculation, the Bank reserves the right to propose alternatives to Members, in order to bring the yellow Account to the condition prior to the error. Members declare that they will cooperate with the Bank in order to reinstate yellows incorrect entries that either result in their benefit or expense.
3.6 In case Members lawfully exercise the right to withdraw or cancel, revoke or not complete the transaction, for which they were rewarded through the Program, the Bank has the right, at its sole discretion, to unilaterally delete yellows corresponding to the above mentioned transaction, without any prior notice to Members.
Article 4 - yellows Redemption
4.1. yellows Redemption Options: yellows accumulated by Members can be redeemed through the following options:
a. In total, by acquiring Gift Cards/Discount Coupons from retailers cooperating with the Bank (hereinafter the "Partners") for the purchase of goods and/or services in any of their retail and/or online stores. Before Gift Cards/Discount Coupons are granted, the Bank will duly identify Members, who may receive them in hard copy from the Network and/or in electronic format (e-mail, SMS, etc.) through www.yellowday.gr and/or the corresponding yellowday mobile device application, provided they have phone banking codes or by any other means provided in the future by the Bank which will be disclosed to the Program Members according to Article 5.
In case Members wish to be informed about the right to cancel the Gift Card/Discount Coupon that they have already acquired (provided that it has not expired or been redeemed) or if they require further information on how to use the Gift Card/Discount Coupon, they must visit one of the Bank branches, if they have acquired the Gift Card/Discount Coupon from the Network, or call the Contact Center by dialling 18218 if they have acquired the Gift Card/Discount Coupon from www.yellowday.gr or by electronic means (pc, mobile phone, tablet), provided they have phone banking codes. Each Gift Card/Discount Coupon is valid for a period of three (3) calendar months from the date it was issued or granted or any other period the Bank and/or the Partner designates and notifies Members thereof.
Members may use one or more Gift Cards/Discount Coupons in each transaction with a Partner, according to the terms indicated on them. Gift Cards/Discount Coupons are valid if they bear all the following information: i. the Partner's identity and/or its trademark, ii. the Gift Card/Discount Coupon's nominal value, iii. its value in yellows, iv. the Gift Card/Discount Coupon's code, v. the date it was issued/granted, vi. its expiration date (from the date of issue) by which the owner of the Gift Card/Discount Coupon may redeem it and vii. the terms of the offer. Gift Cards/Discount Coupons can be redeemed in the Partners' retail shops either by Members or third parties appointed by Members (hereinafter the "Bearers") who may carry out a purchase from a Partner of equal or greater value than the Gift Card/Discount Coupon's balance.
If the purchase from the Partner exceeds the Gift Card/Discount Coupon's nominal value, the Bearer must pay the difference to the Partner, either in cash or by any other means agreed between them. In so far as the cost of purchases is covered by the Gift Card/Discount Coupons' value, the Bearer will be exempted from any obligation to pay the Partner.
If the total cost of purchases is less than the Gift Card/Discount Coupon's value, the Partner shall, in no case, pay the difference to the Bearer and the Gift Card/Discount Coupon will be considered redeemed. Gift Cards/Discount Coupons can never be redeemed in cash and their Bearer to the Partners is considered to be the Member according to these terms, and the Bank is not liable in the event of redemption by a non-Member. Members are exclusively and solely responsible for the acquisition and redemption of Gift Cards/Discount Coupons by third parties. The timely redemption of any Gift Cards/Discount Coupons by the Bearer includes all products on offer and at any time, also regarding products sold by the Partners that are on sale or on any kind of offer during the sales period as well as on days that Partners have designated as "Seasonal Offers", unless otherwise specified in the Gift Cards/Discount Coupons' terms, of which the Bearer must be informed. In case of loss or theft, Gift Cards/Discount Coupons are not replaced. When Gift Cards/Discount Coupons expire, they will not be accepted and cannot be replaced by others.
b. In total or in part, by acquiring goods and/or services from the Bank's Partners that have point-of-sale terminals (hereinafter “POS”) and/or receive remote or not payments by card (hereinafter "e-POS"). These Partners are posted on the Bank's official website to inform Program Members. In case Members make a successful transaction using the Card issued by the Bank, (which is eligible for yellows accumulation according to the Table), through the Partners' POS and/or e-POS, they may redeem all or part of the yellows they accumulated during the Program with these Partners. This has to comply with the Program's redemption criteria, as referred to in 2.2 and may be specified in the Table, which forms an integral part of the above mentioned Program's Terms. yellows redemption will be subject to the rate agreed between the Bank and the Partners. The total number of yellows before and after redemption and the amount which corresponds to a specific number of yellows to be redeemed will be displayed through a special POS/e-POS application. Partners must inform customers, as applicable. In cases redemption regards part of the value of goods and/or services, such redemption will concern a specific amount of the total value of the goods and/or services, corresponding to a specific number of yellows. The Bank reserves the right to suspend the right of a Partner to redeem yellows that have already been accumulated by Program Members.

c. In part or in total, through the Piraeus Bank Group "yellowday" service (hereinafter "yellowday"). In particular, Program Members, provided they own a card issued by Piraeus Bank and use the yellowday service (provided by the SA company under the name "Piraeus Direct Services SA Financial - Telecommunications Services and Electronic Commerce", hereinafter "PDS"), after being identified using the yellow Activation Code and the yellowday Codes and with their prior consent, may redeem accumulated yellows in total or in part to purchase either Gift Cards (Discount Vouchers) or Discount Coupons, according to the Bank's instructions and the Terms of Use of the service, of which they were informed and have accepted. Gift Cards/Discount Coupons may be redeemed with Partners that display, offer, promote and sell their products/services through yellowday, under the terms and conditions that apply regarding the Terms of Use, of which Program Members are informed and accept unreservedly, provided they have registered in yellowday.

4.2 The Bank reserves the right to offer other redemption options for yellows in the future and will inform its Members accordingly.
4.3 The Bank may define, at any time, a minimum and/or maximum number of yellows to be redeemed in total and/or in part per transaction, which may change as a whole or may be modified by the Bank according to the redemption channel. In addition, the Bank and the Partner may agree to apply a minimum and/or maximum number of yellows redemption per transaction, exclusively at the Partner's retail/online stores. The minimum and/or maximum number of yellows redemption will be posted on the Program's official website.
4.4 Moreover, the Bank may define, at any time, a maximum number of yellows redemption on an annual basis for each Member, which will be announced in accordance with Article 5.
4.5 In case of partial yellows redemption, these are deducted from the Member's yellow Account, according to the date they were awarded from the oldest to the newest.
4.6 The conditions under which Gift Cards/Discount Coupons are granted, as well as the yellows redemption option directly through the Partners' POS/e-POS are at the exclusive and sole discretion of the Bank. In case yellows redemption falls under 2.2, then redemption automatically discontinues. This implies, by no means, that yellows will have a new expiration date and the older date shall apply, i.e. the date they were credited to a yellow Account. Please note that the Bank is not obliged to inform Members about redemption discontinuation, nor its reactivation after debt settlement.
4.7 The Bank is not liable for sales agreements and in particular for the price, delivery, quality, etc. of goods and/or services received or obtained by Members from the Partners participating in the Program. The Bank is not liable for any damage or loss suffered by any Member resulting from the Partners' failure to fulfill and/or not properly fulfill their redemption obligations.
4.8 Notwithstanding the specific conditions mentioned under these terms and the Table, which forms an integral part of the Program Terms, yellows are accumulated, maintained and redeemed solely and exclusively according to the Program Terms, as applicable.
4.9The Bank may announce special yellows redemption or accumulation offers or other offers in the context of promotions either to all Members or to selected customers, as regards either selected rewards or specific transactions according to its policy. Members are informed in the way referred to in Article 5.
4.10 The Bank shall not be held liable towards its Members if a Partner discontinues cooperation and is accused of misleading them.
Article 5 - Members Program statement and yellow Account Statement
5.1 Program Statement: Members are informed of the Program’s terms and amendments through the Network, the Bank's official website www.piraeusbank.gr/yellow, the Contact Center and/or by any appropriate means at the Bank's discretion (by fixed or mobile phone, SMS, e-mails, winbank etc.).
5.2 yellow Account Statement: Members can be informed on their yellow Account activity (available balance, yellows accumulation, redemption and expiration according to the date and method of acquisition/redemption/expiration, and choice of accumulation/redemption channel) for a period determined by the Bank and through a means designated by the Bank each time, currently through winbank, the Contact Center -provided Members have phone banking codes- the Network, yellowday and otherwise defined in the future. The Bank reserves the right to inform Members through fixed and/or mobile phone, SMS, e-mails, newsletters, personal letters, etc. according to the data the card holder has disclosed to the Bank.
Article 6 - Program Amendment, Termination and Suspension by the Bank, Membership Deletion, Membership Cancellation
6.1 The Bank reserves the right to amend Program Terms and Conditions at any time, including the terms of the Table, and amendments will be announced to Members by the means mentioned in Article 5. Program Terms may be amended without the Members' prior notice and consent. Members should visit the Bank's official Program website regularly to keep themselves informed about any amendments, as well as the Program's latest version. Making use of rewards or activities and/or yellows redemption following any amendments constitutes acceptance of the amended Terms.
6.2 The Bank reserves the right to suspend and/or terminate the Program at any time, at its sole discretion without justification or deadline, thereby informing its Members under Article 3 and guiding them to redeem their yellows. Furthermore, the Bank has the right to suspend a Member from using the Program, for reasons relating to: (a) the safety of the product/service, (b) the suspicion of unauthorized or fraudulent use, etc. It is noted that in these cases, the Member's accumulated yellows will be permanently deleted.
6.3 The Bank has the right to delete/deactivate Membership due to Member's failure to comply with the present terms and/or generally in the framework of its overall banking relationship, according to the provisions of article 2.2. Subsequently, available yellows will be permanently deleted from yellow Account.
6.4 Members have the right to request their deletion from the Program and submit this request in writing to the Network at any time. All available yellows will be automatically deleted from their yellow Account on the date of submission.
Article 7 - Personal Data Process Notice/Consent
7.1 Each Member accepts that personal data that have been or will be lawfully received by the Bank in and for the purpose of servicing its participation in the Program will be processed by the Bank in accordance with the particulars mentioned in the information leaflet " Personal Data "received, has been informed of its content and is an integral part of these terms.
7.2 The Bank participates in the institution of Ombudsman for Banking and Investment Services. If the dispute between the Member and the Bank is not possible to be settled between them, the Member may address to the aforementioned institution, being an institution of alternative dispute resolution (ADR), registered in the special registry kept at the General Division of Consumer Protection and Market Supervision (1 Massalias Street, 10680, Athens, www.hobis.gr, tel. : 210 3376700, Fax: 210 3238821, email: info@hobis.gr), for an out-of-court settlement.

Τaking into account that the dispute concerns contractual obligations under electronic contract of service provision, the Member may submit the request for an out-of-court dispute settlement via the platform of Electronic Dispute Resolution (EDR) on website https://webgate.ec.europa.eu/odr

Article 8 - OTHER TERMS
8.1 In case Members fail to comply with any of the Program's terms, the Bank has the right to directly disqualify them from the program, to suspend and/or terminate their membership and cancel all yellows accumulated in conjunction to the Program.
8.2 The terms of the Program are governed by Greek Law. The courts of Athens shall have sole jurisdiction for the resolution of any dispute arising from their application.
yellows REWARDS TABLE
This updated Table forms an integral part of the Program's Terms. It is posted on the Bank's official Program website and represents the current Piraeus Bank policy on yellows rewards options for Members participating in the “yellow” Program. The Bank reserves the right to amend the Terms of the Table at any time. The amendments will be announced to the Members through the Network, the Bank's official website www.piraeusbank.gr/yellow, the Contact Center and/or any appropriate means at its discretion (via fixed or mobile phone, SMS, e-mails, winbank etc.). The Program Terms may be amended without the Members' prior notice and consent. Members should visit the Bank's official Program website regularly in order to keep themselves informed about any amendments, as well as to see the Program's latest version.

1. General terms

Members of the "yellow" Program are rewarded for the following transactions/services, notwithstanding the specifically defined exceptions:
1.1 Purchases and bill payments by Credit, Debit and Prepaid Cards issued by Piraeus Bank regardless of the channel (Network, Internet, etc.) used in each case by the Member.
1.2 Activation and use of winbank Electronic Banking.
1.3 "Do It Yourself" Time Deposit Account.
1.4 Payment of Energy, Telephony/Internet, Water and Insurance bills through Standing Orders linked to a deposit account.
1.5 Disbursement of a subsidized loan "Exoikonomisi Kat’Oikon II" Program
1.6 Disbursement of the loan «e-loan by winbank»
1.7 With the full repayment (in full), of the mortgage and consumer monthly loan installment
1.8 Finally, they can convert the "Note Points» they have accumulated by using the "Check in class" service to yellows, as provided in the Check in class Terms of Service and the yellow Program Terms.

2. Special terms

25.000 yellows on a monthly basis per Card category yellows will be registered in the Member’s account within a period of 5 business days after the transaction has been cleared for the entire amount. In particular, yellows derived from credit card transactions with installments, are registered as follows:

1st case - if the transaction takes place in a Premium Merchant (physical store-POS) and in yellowday.gr, then the yellows accrued refer to the total amount of the transaction.

2nd instance - if the transaction takes place in a Premium Merchant (online store - ePOS), then the accrued yellows may, depending on the merchant, either refer to the total amount of the transaction or only to the amount of each installment . The relevant information is available for each Premium Merchant, through the official informational website of the Bank for the Members of the Program.

3rd case - if the transaction takes place in an Enterprise that does not participate in the Program , then the yellows accrued, refer only to the amount of the installment being charged

General Remarks - Cards

Eligible Cards are displayed on the Bank's official website www.piraeusbank.gr/yellow Transactions made by Cards (Credit, Debit, Prepaid cards) issued by Piraeus Bank may include any purchases/payments performed in shops, via telephone, internet and standing orders. Prepaid card charges, cash withdrawals, balance transfers from other cards, money transfers (incoming and outgoing funds), credit card bill payments (minimum or total) due to debt, annual subscription fees, over-limit charges, any interest/expenses that may be charged to the Card, and any credits and transactions disputed by the Cardholder are not eligible. The Bank reserves the right to amend, supplement or remove types of transactions by Card according to its policy.

Regarding transactions by Card, yellows are awarded for every euro and in case of decimals the amount will be rounded down to the nearest integer. It is noted that if the transaction amount is less than 1 (one) euro, Members do not accumulate yellows.

In case Members perform contactless transactions by Card without using its plastic component in the context of Piraeus Bank Winbank Mobile Wallet service, Members accumulate yellows according to the above mentioned methods. It is specified that the use of the Card's plastic component is required in case Members wish to redeem yellows.

B. Deposits

Payments eligible for the Program appear in detail in the Bank's Billing Statement under "Standing Orders".

C. E- Banking

500 yellows once yellows will be credited to the yellow Account upon completion of the login to Winbank only once regardless of whether it was a Web or Mobile Banking login. The reward includes quick login in Mobile Banking.
b. Bill Payments via Web Banking With every successful payment via Web Banking linked to deposit account or a credit card Customers with access to Web Banking provided they are enrolled in the Program 25 yellows per payment 250 yellows on a monthly basis yellows will be credited to the yellow Account upon completion of login to Web Banking. In case Members perform a payment by credit card eligible for the Program, they accumulate yellows by using this card. The maximum number of yellows, namely 250 yellows, refers only to the “Bill payments via Web Banking” rewards option, while the aforementioned provisions under 2A apply regarding the use of credit cards.
c. Bill payments via Mobile Banking With every successful payment via Mobile Banking linked to a deposit account or a credit card Customers with access to Mobile Banking service provided they are enrolled in the Program 25 yellows per payment 250 yellows on a monthly basis yellows will be credited to the yellow Account after Members log in to the Mobile Banking service. In case Members perform a payment by credit card eligible for the Program, they accumulate yellows by using this card. The maximum number of yellows, namely 250 yellows, refers only to the “Bill payments via Mobile Banking” rewards option, while the aforementioned provisions under 2A apply regarding the use of credit cards.

D. Individuals Loans

General Remarks - Loans

The Program includes Consumer and Mortgage Loans of Individual Persons
1. Prerequisites for the yellows Collection:
a) Payment of the entire installment of the loan at the date agreed with the Bank. In Open Loans, only the amount corresponding to the minimum payment as agreed for calculating the yellows, is taken into account.
b) The absence of overdue debts on the loan (eg premiums, insurance fees, expenses)
2. yellows are allocated for each whole euro unit and in the case of decimal points, yellows are rounded down.
3. The calculation of the yellows does not take into account payments relating to premiums, insurance fees and expenses.
4. For loans granted in a currency other than the euro, yellows awarded, take into account the equivalent in euro as calculated for the payment of the installment of the loan.
5 The Program excludes:
(a) Loans of which the Principal Debtors are employed in a paid or dependent employment relationship with the Bank and its associated companies, of the Bank Group
(b) loans granted for the purchase of a vessel,
(c) loans granted for the purchase of shares
(d) Overdraft limits
(e) Mortgages and Consumer Loans, where the terms relating to repayment of the loan due to debt settlement / restructuring have been modified or a new contract has been concluded due to settlement / restructuring of debts, subject to paragraph 6.
6. In particular, the Mortgage and Consumer Loans referred to in paragraph (e), all of which are payable in due time and duly for the period from the date of signature of the amending act or contract as detailed below:
(a) two (2) years if the relevant amendment or contract was concluded before ninety (90) days from the date of payment of any debt
(b) three (3) years if the relevant amendment or contract was concluded after ninety (90) days from the date of payment of any debt.
7. The Bank may, in its sole discretion, modify the conditions for participation of the Loans in the Program
